Terms & conditions of hire
Definitions
“The Company/We/Us” – Raffles Limousines
“The Hirer” – the person whose details and signature appear overleaf
“The Driver” – the Company’s driver for the duration of the contract
“The Services” – the services requested by the Hirer as detailed overleaf
“The Overall Price” - the total of the individual fares agreed between The Company and the Hirer for the Services.
The Hirer must be 18 years of age or older. The Hirer remains liable under these terms notwithstanding the Hirer may not be travelling in the limousine.
Deposits, balances and refunds
No reservation will be confirmed until a properly completed booking form and deposit have been received.
A non-refundable deposit is payable on making a reservation. Whilst the Company will note any reservation requested without payment of a deposit, the Company reserves the right to accept other bookings at the same date and time. The Company will notify the Hirer that the Company is no longer able to supply the Services within 7 days of receiving a cleared funds deposit in respect of the new reservation.
The balance of the Overall Price after deducting the deposit is payable at the time and place of the first collection point as detailed overleaf. If payment of the balance is not made at that time and place the Company reserves the right to immediately cancel the contract. The Company will not be required to make any refund.
Period of the hire
The Company will use its best endeavours to ensure that its vehicle arrives at or shortly before the collection time stated overleaf. However, the Company reserves the right to a “grace” period of 30 minutes to allow for unforeseen incidents, weather or traffic conditions. The Company shall not be liable for any losses as a result of the late arrival of its vehicle, howsoever caused. The Driver will endeavour to make up the time.
It is the responsibility of the Hirer to ensure that the party is present at the agreed collection points and at the times stated overleaf. In the event that the Hirer is not present, the Driver will endeavour to contact the Hirer using the telephone number(s) given. In the event that the Driver cannot contact the Hirer, the Driver will remain for a waiting period limited to 15 minutes beyond the collection time stated. Thereafter the Company reserves the right to terminate the contract without refund or compensation being payable. If the Driver is required to delay departure beyond the stated waiting period by the Hirer for any reason whatsoever, the Hirer shall be liable to pay further charges of £20 per half hour or part thereof.
The hire is for the period agreed and the Overall Price applies to that period only. In the event that the Driver is required to extend the hire period, any additional time shall be chargeable at a cost of £30 per half hour or part thereof. Sometimes further commitments for the Company’s vehicle may prevent agreement to such an extension. The Driver is the sole arbiter as to whether or not an extension shall be agreed to.
In respect of collections from an airport in circumstances where the Hirer or any person in the party is delayed due to a delayed flight, and subject to availability, the Driver will remain with the vehicle at the collection address notwithstanding no arrangement has been made for an extension to the collection time. This additional waiting time shall incur additional hire charges at a cost of £20 per half hour or part thereof.
Conduct and behaviour policies and limits of liability
The Hirer is responsible for the conduct of the party. The Hirer is liable to pay for any damage caused to the Company’s limousine whether by a member of the party or my any other person incited to cause damage by any act or omission of any member of the party.
The Company reserves the right to charge for any damage caused to its limousine as follows:
Should any damage be caused to the interior fabric of the Company’s vehicle, including but not limited to the seats, ceiling and carpet, a damage fee of £150 shall be payable by the Hirer. If the repairs cost less than this to effect the balance shall be refunded to the Hirer.
In the event that any member or members of the party are ill due to alcohol consumption, a “sick” fee of £100 shall be payable by the Hirer.
The two fees stated above are independent of each other.
Breakages to glasses shall be chargeable at a cost of £8.00 per item
Smoking is not permitted in the Company’s vehicles. If any member of the party should be in breach of this term, the Driver may require the person or the entire party to leave the vehicle. The party shall be responsible for arranging alternative transport. The Company shall not be liable to pay any refund or compensation. The Driver will endeavour to accommodate any request for a “comfort” break.
Alcohol may be brought by the Hirer or any member of the party for consumption in the Company’s limousine. However, the Company operates a strict “NO ALCOHOL” policy in respect of persons in the party under the age of 18 years. The consumption of alcohol in the limousine by persons under the age of 18 is expressly prohibited and the Company will terminate the hire and require the entire party to vacate the vehicle if the Driver has good reason to believe anyone in the party is in breach of this clause.
All parties must contain at least one person who is 16 years of age or above. It is the Hirer’s responsibility to ensure this term is complied with. In the event that no person of 16 years of age or over is present in the party at the collection address, the contract shall be terminated and the Driver shall refuse entry to the limousine. The Overall Price shall remain payable.
The contract may be terminated at the discretion of the Driver in the event that any member of the party exhibits violent or abusive behaviour which in the Driver’s opinion may place the Driver, the vehicle, any member of the party or any other person at risk. In those circumstances the Company reserves the right to refuse entry to the vehicle to the person in question. That person shall be responsible for arranging alternative transport. The Company shall not be liable to pay any compensation or refund.
The Company shall not be liable for any losses suffered as a result of the vehicle breaking down or being involved in an accident, howsoever caused.
The Company accepts no responsibility for any loss or damage to any personal effects whilst in the vehicle.
Cancellation
In the event that the reservation is cancelled before the deposit is paid, no money shall be payable. In the event that the reservation is cancelled after payment of the deposit, the following terms shall apply. If the reservation is cancelled
more than 90 days prior to the date of hire, the deposit paid shall be forfeit. No further charges shall be levied.
between 90 days and 30 days prior to the date of hire, 50% of the Overall Price or the deposit, whichever is the greater, shall be payable. Credit shall be given for the deposit already paid.
less than 30 days before the hire date, the full balance of the Overall Price shall be payable.
The Hirer is responsible for any charges made by the Company for whatever reason.
Licensing restrictions
The maximum number of people a stretched limousine can carry is 8. This is a legal requirement. Under no circumstances will the Driver permit more than 8 passengers to travel in any of the Company’s stretched limousines.
The Company is issued with a licence to operate Passenger Service Vehicles by the Traffic Commissioner’s Office (“the Licence”). The restrictions of the Licence require each passenger to pay an individual fare. These fares may be collected by the Hirer in advance but it is the Hirer’s contractual duty to ensure that a separate fare has been paid in respect of each passenger. The per-head fare shown overleaf is based on the number of passengers specified by the Hirer, or the maximum occupancy for the vehicle where no number is specified. Tickets will be supplied to the Hirer prior to the hire date to be distributed to the individual passengers. Each passenger will be required to present their ticket to the driver prior to entry to the vehicle. We reserve the right to refuse entry to any passenger not in possession of their ticket. Passengers should be informed that they may be required to present their ticket for inspection by an official of the Transport Office and/or the Vehicle Operators Standard Agency (VOSA).
It is a further restriction of the Licence that the hire terminates either at the same address as the first pick-up or at an address not less than 15 miles (in a straight line) from the first collection address. This requirement will be strictly adhered to by the Company.
